Flipkart challenges Karnataka HC judgement

Amazon also tags along with Flipkart in the appeal.

Mysuru: Flipkart has challenged the last week’s judgement of the Karnataka High Court allowing the Competition Commission of India (CCI) to continue its investigation against the company in a division bench. Amazon’s counsel also asked to be tagged along, and the request for that has been accepted.

Reports say that unless the companies get a stay order from the court, the CCI will continue its investigation. On June 11 the Karnataka High Court dismissed the writ petition of Amazon and Flipkart allowing the CCI to continue its investigation.

The Delhi Vyapar Mahasangh, a group representing small and medium businesses in the national capital submitted a plea with the CCI against Amazon and the Walmart-owned Flipkart accusing them of anti-competitive practices, predatory pricing and preferential treatment of sellers almost 18 months ago.

These complaints were filed under Sections 3 and 4 of the Competitive Act.

The CCI then passed an order ordering the director-general to investigate the allegations. This order was then challenged by Amazon through a writ petition in February 2020 in the Karnataka High Court, and the HC put a hold on the investigation. In September 2020, following the stay, the CCI challenged the order in the Supreme Court, and the case was again sent back to the High Court ordering the case to be heard as soon as possible.

Months after that, the Karnataka HC passed its judgement in the favour of the CCI and now the two e-commerce giants have challenged the judgment after months of denying accusations.
